RISEUP Terms of Service

These Terms of Service ("Terms") govern your use of RISEUP, an app developed and operated by Maged Ghattas, an individual developer trading as "Aurix Labs" ("we", "our", or "us"). By downloading or using RISEUP, you agree to these Terms. If you don't agree, please don't use the app.

1. The Service

RISEUP is a personal fitness training app that builds and adjusts workout plans based on information you provide and your ongoing feedback. RISEUP runs locally on your device; some features (optional cloud backup, subscription purchases) connect to third-party services as described in our Privacy Policy.

2. Health & Fitness Disclaimer — please read this section

**RISEUP is not a medical device, and nothing in the app is medical advice.** RISEUP is a general fitness and exercise tool. Before starting any exercise program, including RISEUP, you should consult a physician or other qualified healthcare provider — especially if you have any pre-existing medical condition, injury, or concern about your ability to exercise safely.

By using RISEUP, you confirm that:

- You are voluntarily participating in physical activity and   understand that exercise carries an inherent risk of injury.

- You are solely responsible for assessing your own physical   condition and capabilities before and during any session.

- Information you provide about injuries or limitations helps RISEUP adjust your plan, but this is not a substitute for professional medical guidance, and RISEUP cannot detect or diagnose any medical condition.

- You will stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or any other

warning sign during a session.

To the fullest extent permitted by law, Aurix Labs is not liable for any injury, health complication, or damage arising from your use of RISEUP or participation in any exercise it suggests.

3. Eligibility

You must be at least 16 years old to create a RISEUP profile and use the app. By using RISEUP, you confirm that you meet this age requirement. RISEUP is a physical exercise app intended for independent adult and teen use, and is not designed or directed toward younger children.

4. Your Account & Data

RISEUP does not require a server-based account. Your profile and progress are stored locally on your device, and optionally backed up to your own Google Drive or iCloud account, entirely under your control (see our Privacy Policy for details). You are responsible for the accuracy of the information you enter, since RISEUP's recommendations are based on it.

5. Subscriptions & Payments

RISEUP offers optional Pro features through a one-time purchase or recurring subscription, processed through the Apple App Store or Google Play and managed via RevenueCat.

- Subscriptions automatically renew unless cancelled at least 24 hours   before the end of the current period, through your Apple ID or Google Play account settings — RISEUP cannot process cancellations or refunds directly.

- Pricing, free trial terms, and billing cycles are shown at the time of purchase and may change with notice.

- Refunds are handled according to Apple's or Google's own refund policies, since payments are processed through those platforms.

6. Acceptable Use

You agree not to: reverse-engineer, decompile, or attempt to extract the source code of RISEUP except where permitted by law; use RISEUP for any unlawful purpose; or attempt to disrupt or interfere with the app's normal operation.

7. Intellectual Property

RISEUP, including its design, content, workout logic, and branding, is owned by Aurix Labs. Using the app does not grant you ownership of any part of it. Your own personal data (profile, progress, etc.) remains yours.

8. Disclaimer of Warranties

RISEUP is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the app will be error-free, uninterrupted, or that it will produce any specific fitness outcome.

9. Limitation of Liability

To the fullest extent permitted by law, Aurix Labs shall not be liable for any indirect, incidental, special, or consequential

damages arising from your use of RISEUP, including but not limited to personal injury, loss of data, or loss of access to the app.

10. Termination

You may stop using RISEUP at any time by uninstalling the app. We may suspend or discontinue any part of the service at our discretion, including in response to misuse of the app.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of RISEUP after changes are published means you accept the updated Terms. The current version will always be available on this page.

12. Governing Law

These Terms are governed by the laws of **the Arab Republic of Egypt**, without regard to conflict-of-law principles, reflecting Aurix Labs' current status as an individually operated business based in Egypt. This section will be updated if and when Aurix Labs incorporates in another jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or

removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aurix Labs regarding your use of RISEUP, and supersede any prior agreements or understandings on this subject.
